Non-Renewal of Principal Employment Agreement

Principal employment agreements are for one (1) year. There shall be no implied right of reemployment, renewal, or extension of the existing employment agreement. The principal, the school and/or the Office of Education have no obligation to enter into any subsequent employment agreement in the future.

While the decision not to offer a subsequent employment agreement can be made by the pastor or the Office of Education (for diocesan schools) for any reason or no reason. At a minimum, an employment agreement shall not be offered when a principal has failed to act in accordance with the doctrinal and moral teachings of the Catholic Church, has violated the policies of the Diocese, the principal employment agreement, local school policies or otherwise fails to perform designated responsibilities in an appropriate and satisfactory manner, as determined by the pastor or Office of Education (for diocesan schools).

The pastor is to inform the Office of Education when considering the non-renewal of a principal's employment agreement by February 28.

A principal, whose employment agreement will not be renewed, shall receive a written notice by March 15, unless circumstances exist which necessitate notification after that date. Grounds for not renewing an employment agreement shall include, but shall not be limited to, failure to provide leadership in forming the Christian educational community; violation of accepted academic or professional standards of conduct; failure to perform duties in a satisfactory manner; failure to act in accordance with the philosophy of the school; failure to obtain or maintain required certifications or approval from the Office of Education; lack of continuing professional growth and performance; non-observance of diocesan and local school policies; violation of principal's employment agreement; failure to manifest an active participation in the Christian education community; failure to teach, live and act in accordance with doctrinal and moral teachings of the Catholic church; or for any other reason as determined by the sole discretion of the pastor or Office of Education (for diocesan schools) upon consultation of the Office of Education.

When appropriate and feasible, a principal may be given an opportunity to improve his/her performance within a realistic timeline in the specific area where improvement is needed, but this shall not be required. If such an opportunity is provided, substantial improvement must be obtained before any consideration of renewal or awarding of a subsequent contract (see Policy and Regulation 2211.7 for guidance).

The pastor may inform the local advisory council and review procedures that have led up to the decision for non-renewal.

The Diocesan Board of Education Policies and Regulations do not in any way constitute a binding contract or in any way guarantee any rights or promises of any particular term or condition of employment or subsequent employment. The Pastor and the Office of Education (for diocesan schools) retain the absolute right to determine the terms and conditions of the employment of the principal.
